The present application has been filed on behalf of the petitioner th seeking modification of the order dated 12 September, 2025, passed by this Court.

Learned Senior Counsel appearing for the petitioner submits that th when the present petition was listed for hearing on 12 September, 2025, the same was disposed of on the basis of a statement made on behalf of the petitioner.

said statement had been made without prejudice to the rights and contentions of the petitioner.

The aforesaid statement is taken note of.

This Court notes that the representation of the petitioner on the basis of which, the writ was disposed of, is already pending before the Municipal Corporation of Delhi ("MCD").

It is clarified that the right of the petitioner to use the rear side of the property, shall be considered by the Appellate Tribunal MCD ("ATMCD") and appropriate orders shall be passed therein. 7.

At this stage, learned counsel appearing for the petitioner points out that the MCD is allowing other people to use the same lane, which is the rear side of the property of the petitioner.

If that be the case, let action be taken by the MCD against the other properties also, in accordance with law.

This Court also takes note of the submission made by learned counsel appearing for the MCD that the Sealing Order dated 22nd July, 2025, has been kept in abeyance in view of the representation of the petitioner. 10.

Noting the aforesaid, the present application is accordingly disposed of.
