O R D E R

The present writ petition has been filed seeking directions to respondent no. 1 to demolish the illegal and unauthorized construction done by respondent no. 2 at property bearing no. C-11, Anup Nagar, Uttam Nagar, New Delhi-110059.

Learned counsel for the respondent no. 1-Municipal Corporation of Delhi ("MCD") submits that unauthorized construction in the property in question has already been booked on 10th September, 2025. 3.

Learned counsel for the MCD further submits that requisite action shall be taken, after following the due procedure. 4.

At this stage, learned counsel for the petitioner submits that the unauthorized construction is still going on.

Considering the submissions made before this Court, since the MCD has already booked the unauthorized construction in the property in question, it is directed that the MCD shall take requisite action against the property in question, after following the due procedure. 6.

In case of any ongoing unauthorized construction, the same shall be stopped forthwith, by the concerned officials of the MCD, with the assistance of Station House Officer ("SHO"), Police Station, Uttam Nagar, New Delhi.

Learned counsel appearing for the respondent no. 3-SHO, Police Station, Uttam Nagar, New Delhi submits that full assistance shall be provided to the MCD, as and when action is sought to be taken by the MCD, against the property in question.

Accordingly, the MCD is held bound to take action, after following the due procedure, against the unauthorized construction existing in the property in question.

However, the right of respondent no. 2 is reserved. In case the respondent no. 2 is aggrieved by any action on the part of the MCD, the respondent no. 2 shall have the liberty to seek remedies, in accordance with law.

Likewise, in case the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner shall be at liberty to approach the Special Task Force ("STF"), as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., and other connected matters, in W.P.(C) 1807/2018, and Fazruddin Versus DDA and Ors, in W.P.(C) 4649/2017.
