This petition is filed by the Petitioner under Section 11(6) of Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of a Sole Arbitrator.

Disputes have arisen between the parties from Leave and Licence Agreement executed on 16.01.2018. Petitioner filed a commercial suit bearing No. CS(COMM.) 523/2023, however, on an application filed under Section 8 of 1996 Act by the Respondent, the suit was disposed of giving liberty to the Petitioner to take recourse to arbitration, pursuant to which Petitioner sent notice invoking arbitration calling upon the Respondent to ARB.P. 1464/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. consent to appointment of a Sole Arbitrator, but there was no response. 5.

Issue notice.

Mr. Aabhas Kshetarpal, learned counsel accepts notice on behalf of the Respondent and on instructions, while disputing the case of the Petitioner on merits, submits that since existence of arbitration agreement is not in dispute, this Court may appoint an Arbitrator. 7.

Accordingly, Coordinator, Delhi International Arbitration Centre ('DIAC') is requested to take steps for appointment of the Sole Arbitrator. Arbitral proceedings will be held under the aegis of DIAC and fee of the Arbitrator shall be fixed as per fee schedule under DIAC (Administrative Cost & Arbitrators' Fees) Rules 2018.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
