Learned counsel representing the parties are ad idem that in view of the judgment passed by this Bench in MAT. APP. (F.C.) 136/2025 captioned Upinder Kaur Malhotra v Capt Teghjeet Singh Malhotra and Anr, the impugned judgment passed by the learned Family Court is liable to be set aside.

Accordingly, the present appeal is allowed and the impugned judgment is set aside while restoring the case before the learned Family Court to its original number.

The parties through their counsel are directed to appear before the learned Family Court on 29.10.2025.

In view of the above, the present Appeal, along with pending application, is disposed of.
