The present application has been filed on behalf of petitioner under Section 439 Cr.P.C. read (Section 483 BNSS) with Section 482 Cr.P.C. seeking regular bail in connection with FIR No. 591/2024, under Section 109 (1), 3(5) of BNS, registered at PS Nand Nagri. 2.
The case of the prosecution is that on 24.08.2024 at about 10.30 PM at Gagan park, petitioner initially quarrelled with and gave beatings to one Abuzar and when the complainant Shahrukh came to rescue Abuzar, he entered into a quarrel with him as well, resulting in the complainant Shahrukh giving beatings to the present petitioner. After sometime, petitioner came with his friends including co-accused Paras and gave beatings to the complainant. Mr. Gaurav Bhardwaj, learned counsel appearing on behalf of the petitioner submits that the knife injuries are not attributed to the petitioner. The only role attributed to applicant is that he along with other persons had caught hold of the complainant.

He contends that the petitioner is in custody since 29.08.2024 and has no previous involvement, which position is not in dispute. 5.
Per contra, Mr Ajay Vikram Singh, learned APP for the State argued on the lines of the status report.

Considering that the knife injury has been attributed to co-accused Paras and not to the present petitioner and further regard being had to the fact that the applicant is in custody since 29.08.2024 and that the petitioner has clean antecedents, this Court is of the view that the applicant has made out a case for the regular bail.

Accordingly, the applicant is admitted to regular bail subject to his furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/JMFC/Duty JM, further subject to the following conditions:
a. Petitioner shall appear before the Court as and when the matter is taken up for hearing.
b. Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
c. Petitioner shall not come in contact with the victim or any family members of the victim or other witnesses. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is clarified that the observations made herein above are only for the limited purpose of deciding the present bail application and the same shall not be construed as an expression of opinion on merits of the case. 9.
The application is disposed of.
