The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 439 of the Code of Criminal Procedure, 19737) seeks grant of further interim bail for 30 days in FIR No. 882/2015 registered under Sections 302/307/34 of the Indian Penal Code, 1860 at P.S. Nihal Vihar.

It is pointed out that, on earlier occasion, this Court by order dated 6th June, 2025, in Bail Appln. No. 2132/2025, had granted bail to the Applicant for a period of 30 days to enable him to undergo treatment for his chronic kidney disease. Subsequently, in another bail application [Bail Appln. No. 2415/2025], taking note of the fact that Applicant was undergoing treatment, the interim bail was extended for a period of 30 days, on the same terms and conditions. Thereafter, the bail was extended by another period of 30 days in Bail Appln. 2988/2025 by order dated 8th August, 2025. Through the present application, the Applicant seeks a further extension of bail, relying on medical records to contend that his surgery has still not been performed.

Since the surgery has not yet been scheduled, the Applicant is directed to surrender before the Trial Court on or before 14th September, 2025. As and when the date of surgery is confirmed by the doctors, the Applicant shall be at liberty to apply for appropriate orders before the Trial Court. 5.

With the above directions, the application stands disposed of along with pending application.
