Writ Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 8Cr.PC9) and (new Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023), has been filed on behalf of the Petitioners for quashing of FIR No.

225/2018 dated 04.10.2018 under Section 323/341/354/356/379/509 of the Indian Penal Code, 1860 (hereinafter referred to as 8IPC') registered at Police Station Naraina, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement dated 28.08.2024.

On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that on 30.06.2018, there was a wedding reception party of the Respondent No. 2's Uncle, Mr. Yogpal Sudan's son in Patel Banquet Hall, Loha Mandi, Narayana, Delhi. When the Respondent No. 2 was dancing on the DJ around at 11:30 at night, Sunny @ Akash, who was her Uncle's son, his friend, Shahrukh, was also dancing on the DJ. While dancing, a boy named, Shahrukh started misbehaving with the Respondent No. 2 and two boys whom, he was calling Nakul and Vivek, also came there and started abusing the Respondent No. 2. Thereafter, she left the wedding party. Meanwhile, Sunny, Aakash, Shahrukh and two boys whom he was calling Shahrukh, Vivek and Nakul also came out following the Respondent No. 2 and started abusing and fighting again. Shahrukh caught the hair of the Respondent No.

2 and neck from behind and hit her head on the bench due to which, the nose of the Complainant, started bleeding. Thereafter, Sunny @ Aakash came there and he snatched the chain and locket from her neck and broke it. He hit on the chest of the Respondent No. 2 with both his hands due to which the Complainant fell down. 5.

On the Complaint of the Respondent No.2/Complainant, FIR No.225/2018 dated 04.10.2018 under Section 323/341/356/379/354/509/34 IPC, got registered at Police Station Naraina, Delhi. 6.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 28.08.2024. In the Settlement, it was inter alia settled between the parties that they have left with no grievance against each other. that they shall agree to give their respective No Objection(S)/Affidavits. 7.

Today, the Respondent No. 2, who is present in the Court, states that she has no objection if the said FIR is quashed. 8.

The parties are present today in the Court and they have been identified by their respective counsels and the Investigating Officers. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 9.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 225/2018 dated 04.10.2018 under Section 323/341/427/356/379/506/34 of IPC, registered at Police Station Naraina, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
