Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for grant of parole for a period of three months.

Learned ASC for the State submits that an application has not been initially preferred by the petitioner for grant of parole before the Competent Authority as required under Delhi Prison Rules, but a writ petition has been directly preferred before this Court. He further submits that present petition can be treated as representation on behalf of petitioner, for consideration by the Competent Authority, in accordance with Rules. 3.
