% 11.05.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 29th June, 2015 passed in MAC.APP. 383/2007 whereby the respondent was directed to release the compensation amount along with upto date interest in favour of the petitioner and three others in equal proportions.
Learned counsel for petitioner states that despite the aforesaid order, respondent has not released the compensation amount in favour of the petitioner till date.
This Court is of the view that the petitioner has an alternative effective remedy by seeking execution/enforcement of the aforesaid order dated 29th June, 2015.
Consequently, present contempt petition and applications are dismissed with liberty to the petitioner to continue to prosecute the
execution proceedings which is already stated to have been filed. MANMOHAN, J MAY 11, 2017 js
