The Plaintiff has filed the present Suit seeking a decree of partition, permanent injunction and recovery of rent received by Defendant No.1 in respect of the 1/4th share in the suit property. 2.

It is stated by the Plaintiff, who is present in Court today, that he wishes to abandon his claim under the Suit and seeks permission to withdraw the present Suit. The statement of the Plaintiff is taken on record. 3.

Even though an application under Order XXIII Rule 1 CPC has not been filed by the Plaintiff, in view of the statement given by the Plaintiff in Court, this Court is inclined to permit the Plaintiff to withdraw the present Suit in toto.

The Suit is disposed of as withdrawn, along with the pending applications, if any.
