The present petition has been filed by the Petitioner- Sapna under Article 226 of the Constitution of India seeking issuance of writ of habeas corpus for production of her husband who is stated to have gone missing from Aligarh, Uttar Pradesh where he had gone to attend his brother's marriage in July, 2023.

It is the case of the Petitioner that she had last spoken with her husband on 28th October, 2023, when he had informed that he is returning to Delhi. However, it is alleged that thereafter the Petitioner has not been able to establish any contact with her husband. Accordingly, on 1st November, 2023, the Petitioner is stated to have approached P.S. Civil Lines for filing a missing person's complaint.

Mr. Sanjay Lao, ld. Standing Counsel for the State, has handed over a status report dated 7th October, 2024 and the same is taken on record. As per the said report the mother of the husband- Smt. Vimlesh Devi has already filed a missing report being DD No. 51 dated 1st January, 2024 at P.S. Gandhi Park, Aligarh, Uttar Pradesh.

After some arguments, ld. Counsel appearing on behalf of the Petitioner seeks leave to withdraw the present petition with liberty to approach the appropriate Court.

Leave and liberty granted.

Let the investigation for tracing the husband of the Petitioner be continued. The concerned Investigating Officer shall ensure that the Petitioner is not called at odd hours to the Police Station and shall not be harassed. 8.
