This is a petition filed under Section 11(5) of the Arbitration and Conciliation Act, 1996, seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties.

The brief facts of the case are that the petitioner purchased the suit property and respondent No.1, late Smt. Chandro executed title documents in favour of the petitioner through the notarized 'Agreement to Sell and Purchase' as well as 'Possession Letter', both dated 02.05.2022. 3.

The said Agreement to Sell and Purchase has an arbitration clause being Clause No. 7, which reads as under:

"7. That if any dispute arises, out of this sale transaction in this agreement, the second party is entitled to get the said transaction done through Arbitration by appointing Arbitrator whose decision The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The petitioner had filed a suit for specific performance, but in view of the arbitration clause, the suit was dismissed, referring the parties to arbitration vide order dated 10.01.2024. Thereafter, the present petition has been filed.

Mr. Chander, learned counsel appearing for the respondents, has no objection to the appointment of a Sole Arbitrator. 6.

I am satisfied that there is a valid Arbitration Agreement between the parties and there are disputes that need to be settled through the arbitral mechanism.

For the said reasons, the petition is allowed and disposed of with the following directions:

i) Mr. Rizwan, Advocate, Email ID-rizwanoffice0506@gmail.com (Mob. No. 9643349576) is appointed as a Sole Arbitrator to adjudicate the disputes between the parties.

ii) The arbitration will be held under the aegis and rules of the Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi (hereinafter, referred to as the 'DIAC'). iii) The remuneration of the learned Arbitrator shall be in terms of DIAC (Administrative Cost and Arbitrators' Fees) Rules, 2018. iv) The learned Arbitrator is requested to furnish a declaration in terms of Section 12 of the Act prior to entering into the reference. v) It is made clear that all the rights and contentions of the parties, including as to the arbitrability of any of the claim, any other preliminary objection, as well as claims/counter-claims and merits of the dispute of either of the parties, are left open for adjudication The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
