The present appeal is filed challenging the judgment dated 29.08.2025 ('impugned order') passed by the learned Appellate Court upholding the judgment of conviction dated 15.01.2024 and order on sentence dated 17.01.2025, passed by the learned Metropolitan Magistrate, North District, Rohini Courts, Delhi in Cr. Case No. 5295714/2016.

By way of the present petition, the petitioner essentially seeks his release on probation.

By the judgment of conviction dated 15.01.2024, the petitioner was convicted for offences under Sections 279/304A read with Section 34 of the Indian Penal Code, 1860 ('IPC') and Sections 134/187 of the Motor Vehicles Act, 1988. 4.
By the order on sentence dated 17.01.2025, the petitioner was sentenced to undergo simple imprisonment for a period of one year.

Sessions was dismissed by the impugned order and the matter is now pending consideration on quantum of sentence before the learned Court of Sessions.

The record indicates that the petitioner, before the Court of Sessions, has sought his release on probation on which the arguments are being heard by the learned Court of Sessions. 7.
The learned ASJ has also issued notice to the Probation Officer and has called for his report.

Therefore, the petitioner's request for being released on probation is concededly pending before the learned Court of Sessions.

Therefore, the present petition is pre-mature. 10.
The petitioner's prayer for acquittal or in the alternative, release on probation will be considered by the High Court after the final judgment is passed by the learned Court of Sessions. 11.
The present petition is disposed of with liberty to the petitioner to take all arguments before the learned Court of Sessions.

Needless to say, the petitioner is at liberty to take recourse to filing a petition before this Court in case any grievance remains in future.
