On 2nd February, 2018, parties were referred to Delhi High Court Mediation & Conciliation Centre, as they were willing to explore the possibility of amicable settlement.

The parties have settled their dispute and the Settlement Agreement dated 2nd August, 2018 has been received from the Delhi High Court Mediation & Conciliation Centre. As per the Settlement Agreement, the petitioner/management [referred to as 'First Party'] has agreed to pay a sum of `1,40,000/- to the respondent/workman [referred to as 'Second Party'], in full and final settlement of all his claims including reinstatement, backwages, earned wages, earned leaves, bonus, service compensation, gratuity, intervening and the dues (present, past and future), and any other amount including the claims being subject matter of the award dated 05.04.2003 under challenge in the present writ petition. 3.

The respondent/workman has accepted the above amount in full and final settlement of all his claims including reinstatement, backwages, earned W.P.(C) 1299/2006

wages, earned leaves, bonus, service compensation, gratuity, intervening and the dues (present, past and future), and any other amount including the claims being subject matter of the award dated 05.04.2003 in I.D. No.283/1998 under challenge in the present writ petition. 4.

It has also been agreed between the parties that the respondent/workman on receiving the payment of `1,40,000/- as agreed shall have no objection if the petitioner is permitted to withdraw the amount of `60,000/- deposited by him on 18th November, 2008 along with the interest accrued thereupon.

Today, learned counsel for the petitioner hands over a cheque No.041693, dated 3rd August, 2018 amounting to `1,40,000/- to respondent No.1. The respondent No.1, who is present in person accepts the aforesaid cheque in full and final settlement of all his claims. He has no objection if the amount deposited by the petitioner is released in favour of the petitioner in view of the settlement.

The writ petition is disposed of in terms of the Settlement Agreement dated 2nd August, 2018.

The Registry is directed that the amount deposited by the petitioner in terms of the order dated 15th February, 2006 with the Registry of this Court, along with the interest accrued thereon be released in favour of the petitioner.
