Learned counsel for the respondents raises an objection with regard to the maintainability of the present petition on the ground that the petitioner ought to have approached the Armed Forces Tribunal under the Armed Forces Tribunal Act, 2007, for relief.

After addressing arguments for some time, learned counsel for the petitioner seeks leave to withdraw the present petition, while reserving the right of his client to approach the Armed Forces Tribunal on the same cause of action, as raised in the present petition. 3.

Leave, as prayed for, is granted.

The present petition is disposed of alongwith the pending applications.
