After hearing arguments for some time, learned counsel for appellant states that, without prejudice to his rights and contentions, he does not press the present appeal but, however, seeks a direction to learned Trial Court to hear the arguments on his application moved under Order VII Rule 11 CPC as well as under Order XXXIX Rule 1 & 2 of CPC to dispose those of as expeditiously as possible.

It seems that while filing an application under Order VII Rule 11 CPC, the defendants (appellants herein) have taken a preliminary objection that suit is liable to be rejected, in view of the legal bar contained under Section 185 and Section 50 (a) of Delhi Land Reforms Act, 1954. 3.

Be that as it may, in view of the above statement of learned counsel for the appellant, the present appeal is disposed of as not pressed. 4.
