In effect, via CM No. 3833/2021, the petitioner seeks recall of the order dated 05.04.2019 whereby the writ petition was dismissed for nonprosecution. Via CM No. 3834/2021, the petitioner seeks condonation of delay in moving the application for restoration i.e. CM No. 3833/2021. 3.

It is averred that the writ petition was admitted on 07.12.2006 and, thereafter, on successive dates, it was listed only in 2019, albeit, in the regular category. It is submitted that because of the long gap, the matter was, somehow, missed by the counsel for the petitioner. 4.
