The present Appeal has been filed by the Appellant under Section 13(1A) of the Commercial Courts Act, 2015 read with Section 96 of the Code of Civil Procedure, 1908 seeking to challenge an order dated 07.09.2024 passed by Ld. District Judge (Commercial Court), Central/Tis Hazari Courts, Delhi in CS (COMM) No.766/2023 captioned Sanjay vs. Keshav Raj Pandey & Anr, whereby a suit for specific performance of the oral agreement to sell filed by the Appellant was dismissed.

Learned counsel representing the Appellant submits that the Respondents have taken over the possession of the suit property in execution of the suit for specific performance of the oral agreement to sell filed by the Appellant.
