This petition has been filed challenging the Order dated 06.02.2025 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as the 'Tribunal') in O.A. No. 474/2017, titled Bhupesh Rathor v. Delhi Subordinate Services Selection Board & Anr., whereby the learned Tribunal dismissed the O.A. filed by the petitioner herein on the ground that it had been filed without the relevant documents, and therefore, the case of the petitioner was not being considered on merits. 2.

15.09.2025, the petitioner has now filed an additional affidavit placing certain documents on record, which, according to the petitioner, demonstrate that his candidature was wrongly rejected by the respondents under the OBC category.

Without commenting on the documents or their effect, and considering that the O.A. filed by the petitioner was dismissed only on the ground that supporting documents had not been filed before the learned Tribunal, in the interest of justice, we set aside the Impugned Order and restore the O.A. back to its original number. 4.

These documents may be placed before the learned Tribunal by the petitioner by way of an additional affidavit within a period of four weeks from today. The learned counsel for the respondent may file a response thereto within a period of four weeks thereafter. 5.

The learned Tribunal shall consider the effect of these documents on their own merits.

The parties shall appear before the learned Tribunal on 19th January, 2026.

The present petition, along with the pending applications, is disposed of in the above terms.
