Learned Counsel for the Petitioner seeks permission to withdraw the present Petition in the light of paragraph 5(2) of the Counter Affidavit wherein the Respondent No. 4 has stated that the litigation was between the Accused Swati Singhal and Amit Dewan and mother of the Complainant Smt. Anjula Shrivastava, who had advanced the loan of Rs.1 crore to the said Accused and also request the IO in his Status Report has mentioned that the Notice issued to the Petitioner was not one under Section 41A Cr.P.C.
