This is a writ petition under Article 226 of the Constitution of India read with Section 528 BNSS seeking directions for transfer of investigation in FIR no. 0236/2025, registered at PS Paschim Vihar East under Sections 308(2)/308(3)/140(3)/115(2)/127(2)/61(2)/3(5) BNS to independent agency i.e. CBI or Crime Branch.

allegations of extortion, abduction, assault and criminal conspiracy involving the police officials of the same police station where the case is registered and therefore the ongoing investigation cannot be fair, impartial and transparent, giving rise to apprehension of bias, hushing up of evidence and miscarriage of justice thereby necessitating transfer of investigation to secure the petitioner's right under Article 21. 3.

Ld. ASC appearing for the State submits that investigation is already complete and charge-sheet has been submitted for scrutiny and after scrutiny the same would be filed before the Court within a period of 2 weeks. 4.

Since the investigation is complete, the petition seeking direction for transfer of investigation has become infructuous. 5.

Petition accordingly stands disposed of.
