The Petitioner- Harmeet Singh Sahni, who is the employer of the detenue has filed the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking a writ of habeas corpus for production of the office employee, Ms. 'M'.

Due to the various messages and oral communication received by Petitioner through Ms. M, it was apprehended by him that she is being forced to marry against her will by her family members and hence the present petition was filed.

To support the Petitioner's case, an employee working in Petitioner's own office has also appeared before the Court today and stated that the girl had made repeated calls to them and that she is being married against her will. 6.
It appears that there have been certain incidents which have taken place in the past where the employer has felt that the family is forcing the girl to get married. At present, she is 36 years of age and has had a failed marriage in the past. The girl however, is clear that she is now getting married on her own will and volition to a distant relative as fixed by her family. 7.
A Status Report dated 7th October, 2024 has been handed over by the Ld. Standing Counsel, Mr. Sanjay Lao, and the same has been taken on record. As per the said status report, the statement of the girl was recorded where she has stated that she is now getting married to a relative with the consent of her family members.

The Petitioner expresses concerns regarding the possibility of any untoward incident happening to Ms. M After having interacted Ms. M and her brother, Ms. M has clarified to the Court that she is not under any coercion and duress and she is getting married on 22nd November, 2024 of her own will and volition. She further states that she does not have any grievance against the Petitioner or any other employees of the Petitioner. The Petitioner further submits that he does not have any intention to interfere in the girl's life in any manner.

In view of the above, both the families and the concerned individuals shall ensure that they do not make any allegations or threats towards each other.
