CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 27.02.2017 Crl. M.A. No. 3288/2017 (Exemption) Allowed, subject to all just exceptions.

BAIL APPLN. 342/2017 1.

Issue notice.

2.

Learned APP accepts notice on behalf of the State. 3.

By the present petition the petitioner seeks bail in case FIR No. 37/2014 under Sections 420/174A/506/34 IPC and Section 4 of the Prize Chit & Money Circulation Schemes (Banning) Act, 1978, registered at PS Dwarka North, Delhi.

4.

The allegations against the petitioner in the above noted FIR are that the petitioner along with others was running a committee and induced the complainants to deposit money in the committee. The complainants were BAIL APPLN. 342/2017

made members of the four committees and the committee amount was ₹10 lakhs, ₹10 lakhs and ₹20 lakhs and half of ₹20 lakhs. Though the Committee for ₹12 lakhs was to be completed in July, 2013 however, the amount was not refunded. Though the complainant deposited ₹9,40,500/- still the money was not refunded to him. Thus there are allegations of cheating and embezzlement of the amount. The petitioner did not seek necessary registration before starting the business of chit fund/committee. 5.

Learned APP for the State submits that the petitioner was declared a proclaimed offender and thereafter arrested. Besides the present FIR, 14 other FIRs have been registered against the petitioner. 6.

Considering the nature of allegations and the involvements of the petitioner, I do not find it to be a fit case for grant of bail. 7.

Petition is dismissed.

8.

Order dasti.

MUKTA GUPTA, J.
