Petitioner is defendant before the learned Trial Court and challenges an order whereby his application moved under Section 8 of Arbitration & Conciliation Act, 1996 has been dismissed.

At the very outset, a query was put to learned counsel for the petitioner as to how this petition was maintainable when there was a statutory right of filing an appeal under Section 37 of Arbitration and Conciliation Act, 1996. 3.

Realizing the above, learned counsel for the petitioner now states that he may be permitted to withdraw the present petition with liberty to file appropriate appeal under Section 37 of Arbitration and Conciliation Act, 1996.

Petition is accordingly disposed of as not pressed in view of aforesaid statement.

Liberty, as prayed, is granted.
