The petitioners are plaintiffs before the learned Trial Court and have filed a suit for declaration and permanent injunction. 2.

The injunction sought is in relation to election for the council of Institutions of valuers.

When the above suit was taken by the learned Trial Court on 27th September, 2024, it merely issued summons for settlement of issues and notice of the injunction application returnable 9th October, 2024 i.e. for tomorrow.

It has not been made clear as to what can be the possible grievance against the above said order.

According to petitioner/plaintiff, there was acute urgency in the matter and the Court should have taken up the application moved under Order XXXIX Rule 1 and 2 CPC then and there and should have passed some order. 6.

Be that as it may, since the matter is already fixed for tomorrow before the learned Trial Court, the present petition is disposed of with request to the learned Trial Court to consider the above said application tomorrow and to further proceed with the matter in accordance with law.
