% 28.02.2018 Complainant has alleged in the FIR that petitioner and his co-accused had induced him to disburse `1,10,00,000/- to him towards loan on the pretext of mortgaging the property of their father, who has since expired. It is submitted that at the time of submitting property paper, it was not disclosed that property was already mortgaged with the bank. Subsequently, complainant came to know that property was mortgaged with the bank. Neither the loan was repaid nor the possession of the property was given to the complainant.

Petitioner and co-accused hatched a conspiracy and by cooking up another story had asked the complainant to handover the property papers to them for some time.

Believing the petitioner and co-

accused property papers were handed over and loan was not returned. Learned APP for State submits that during the investigation, it was revealed that petitioner and co-accused did not cooperate in the investigation and are evading arrest. Their custodial interrogation is required. Keeping in view of the facts and circumstances stated above, I am of the view that petitioner is not entitled to bail. Bail application is dismissed. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
