This is a Petition filed under Article 227 of the Constitution of India seeking setting aside of the order dated 08.05.2025 passed in the Suit bearing T.M. No. 937/2016 (Old No. 113/1990) ("Suit") by the learned District Judge-03, Central District, Tis Hazari Courts, Delhi ("District Court"). 2.

The learned Counsel for the Parties submit that the Suit as well as the Cross-Suit being T.M. No. 939/2016 filed by the Respondent ("Cross-Suit") are listed for final hearing before the learned District Court. 3.

In view of the same, without prejudice to the rights and contentions in the Suit and the Cross-Suit, the Parties agree that the order dated 08.05.2025 may be set aside with a direction to the learned District Court to decide and dispose of the Suit as well as the Cross-Suit on merits, without being influenced by the observations made in the order dated 08.05.2025, as expeditiously as possible.
