By way of present petition, the petitioners seek quashing of FIR No. 692/2023 registered under Sections 498A/323/506/509/34 IPC at P.S. Govind Puri, Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and petitioner No.1 (husband) whereas petitioner Nos. 2 to 4 are the in-laws of the complainant. 3.

Learned APP for the State submits that the petitioners are the only accused persons and respondent No. 2 is the complainant/victim. 4.

Learned counsel for the petitioners submits that the parties have amicably settled their disputes on 24.02.2024 vide a Memorandum of Understanding.

Learned counsel for the parties state that first motion has been granted on 09.04.2024 and the parties are in the process of filing the second motion. Learned counsel for parties, on instructions, state that both the parties undertake to assist and cooperate with each other as well as to appear before the concerned Court at the time of filing of the second motion. It is further informed that the remaining balance payment of Rs.12,50,000/- will be made at the time of second motion.

The petitioners and respondent no. 2, who are present in the Court, have been identified by their respective counsel as well as IO/SI Yashveer, P.S. Govindpuri.

Respondent No. 2 states that she has entered into the aforesaid settlement/agreement with her own free will, volition and without any coercion. She further states that she has no objection if the present FIR and consequent proceedings are quashed subject to encashment of the aforesaid demand draft handed over to her today.

Learned counsel for the petitioners submits that no other proceedings are pending between the parties.

The undertaking given on behalf of both the parties is accepted and taken on record. They shall remain bound by the statement made in the Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed subject to the aforesaid terms and conditions. 11.
