O R D E R

This is an application under Section 11(6) of the Arbitration & Conciliation Act, 1996 for appointment of the Sole Arbitrator to adjudicate the disputes between the parties.

It is stated that the Petitioner awarded a contract for design, engineering, manufacture, assembly, inspection & testing, supply, erection, commissioning & performance, test of 22TPH 45kg/cm2 (square) g (440) +/- 10 degree c boiler to the Respondent.

It is stated that since there were discrepancies in the work done by the Respondent, the Petitioner vide letter dated 16.08.2025 asked the Respondent to pay a sum of Rs. 9,15,00,000/- towards the loss suffered by it.

It is stated that since the claim of the Petitioner was rejected by the Respondent, the Petitioner issued notice dated 26.08.2025, asking the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Respondent to settle the disputes amicably within seven days, otherwise the Petitioner shall proceed further seeking appointment of an Arbitrator. 5.

It is stated that since the Respondent did not reply to the said notice, the Petitioner has approached this Court by filing the instant petition for appointment of an Arbitrator.

During the course of hearing, respective Counsel for the parties jointly request that an independent Sole Arbitrator be appointed to adjudicate the disputes between the parties.

Accordingly, Justice C.T. Ravikumar, Former Judge of the Supreme Court (Mob: 9289243322) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The fees of the learned Sole Arbitrator shall be fixed as per the Fourth Schedule of the Arbitration & Conciliation Act, 1996. 9.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act, 1996 within two weeks of entering into reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression of this Court on the merits of the contentions of the parties. 12.

The petition is disposed of along with pending application(s), if any.
