This petition is filed on behalf of the Petitioner under Section 11(6) of Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of a Sole Arbitrator.

Disputes have arisen between the parties in relation to a Marketing and Operational Consulting Agreement executed on 19.02.2019 for including Petitioner's Hotel 'Heaven Gardens' in Respondent's Franchise Model. As per the Petitioner, a sum of Rs. 45,70,000/- is due to the Petitioner from the Respondent, for which Petitioner filed a suit for recovery before the Principal Sub-Judge, Commercial Court, Ernakulam, which was disposed of by the Court on 15.03.2022 with liberty to the parties to take recourse to arbitration. Consequently, Petitioner sent an invocation notice to the Respondent on 08.03.2023 but the Respondent failed to appoint the Arbitrator.

Mr. Diptiman Acharyya, learned counsel accepts notice on behalf of the Respondent and on instructions, submits that the Court may appoint the Sole Arbitrator.

Accordingly, Ms.

Anshika Saxena, Advocate (Mobile No.

8377944021), is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre ('DIAC'). Fee of the Arbitrator shall be fixed as per fee schedule under DIAC (Administrative Cost & Arbitrators' Fees) Rules 2018.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the parties are left open. 8.
