Learned counsel for the Plaintiffs seeks liberty to withdraw the present suit with liberty to file a fresh suit on the same cause of action. 2.
On the last date of hearing, this Court had put a query to the Plaintiffs with respect to the steps taken by the Plaintiffs to identify the source, which led to the details of the customers, who had placed the prepaid orders and the COD orders falling in the hands of the Defendant No. 1/John Doe entity. 3.
Learned counsel for the Plaintiffs states that the Plaintiffs are conducting an enquiry in this regard, which is still ongoing, and that they will make a full disclosure of the result of the said inquiry when they file their fresh suit.

In addition, learned counsel for the Plaintiffs prays that since this is the second date of hearing in the suit and the Plaintiffs intend to file a fresh suit, the Court fee deposited may be refunded. 5.
In view of the submissions made by the Plaintiffs, the suit is dismissed as withdrawn with liberty reserved. The said statement noted at paragraph 3 is taken on record.

The Registry is directed to refund the Court fee within four (4) weeks in favour of the Plaintiffs.

The suit stands withdrawn and applications stand disposed of.
