The present writ petition has been filed seeking demolition of the illegal and unauthorized construction at the common terrace of flat Nos. 317, 318, 319 and 310, above flat No. 320, GH-13, Paschim Vihar, New Delhi. 2.

Responding to the present writ petition, learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD"), submits that the property was booked on 25th April, 2025, and after following the due procedure, a Demolition Order has also been passed. 3.

She further submits that the MCD has already fixed action for demolition on 17th September, 2025.

appearing for the respondent-MCD, no orders are required to be passed by this Court.

However, it is clarified that this Court has not expressed any opinion on the merits of the action, being undertaken by the MCD. 6.

In case, the petitioners are aggrieved by any non-action on the part of the MCD, they shall have liberty to approach the Special Task Force ("STF"), as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., in W.P.(C) 1807/2018 and Fazruddin Versus DDA and Ors. in W.P.(C) 4649/2017.

In case, the owner/occupiers of the plots in question are aggrieved by any action on the part of the MCD, they shall have the liberty to seek their remedies, in accordance with law.

Considering the aforesaid aforesaid, the present writ petition is accordingly disposed of.
