% 25.07.2019 Petitioner seeks pre-arrest bail in FIR No. 328/2017, under Sections 498A/406/354/34 IPC, registered at police station New Ashok Nagar, Delhi while claiming to be innocent.
While entertaining this petition, interim order was passed on 28th February, 2018 and the parties were referred to mediation on 27th April, 2018. Mediation has failed. However, status report has been placed on record.
Petitioner's counsel on instructions submits that to prove bona fides, petitioner undertakes to furnish a bank guarantee in the sum of ₹5,00,000/- before the trial court within four weeks from today.
Let it be so done.
Without commenting on the merits of the case, interim order of 28th February, 2018 is made absolute. In the event of arrest, subject to petitioner complying with the aforesaid undertaking and furnishing bail bond in the sum of ₹25,000/- with one local surety in the like amount to the satisfaction of Investigating Officer, petitioner be not arrested in this case. Needless to say, respondent-State shall be at liberty to get this order revoked in case petitioner fails to comply with the aforesaid undertaking. This application is accordingly disposed of in aforesaid terms. Dasti.
