Aforesaid two Writ Petitions under Article 226 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('B.N.S.S.') have been filed on behalf of respective Petitioners for quashing of FIR No.0169/2025 dated 05.07.2025 under Sections 316(4)/318(4) of the Bharatiya Nyaya Sanhita, 2023 ('BNS'), registered at Police Station: Crime Branch, Delhi and all consequential proceedings emanating therefrom, in terms of Settlement Agreements dated 11.09.2025 and 27.10.2025 in respective Writ Petitions.

Learned ASCs for the State and learned counsel for Respondent No.2 appear on advance Notice 3.

Learned ASC for the State submits that Chargesheets against both Petitioners have been filed and R. S. Bipin has been put in Column No.12. 4.

As per the allegations made in the FIR, the dispute arose, when out of Rs.2 crore, Respondent No.2 gave Rs.50,00,000/- to the Applicant. 5.

It is further submitted that on 05.07.2025, on complaint of Complainant Vibhor Tandon, FIR No.0169/2025 under Sections 316(4)/318(4) BNS was registered at PS: Crime Branch, Delhi. 6.

In terms of respective Settlement Agreements dated 11.09.2025 and 27.10.2025, Rs.50,00,000/- were to be returned to Respondent No.2 M/s Carbyne Infrastructure Pvt. Ltd., out of which Rs.25,00,000/- have already been paid in August, 2025, which is acknowledged by Mr. Shiv Kirti Singh, AR of Respondent No.2. The balance settled amount of Rs.25,00,000/- has also been paid today in the Court by way of DD No.699507 dated 13.11.2025 drawn on Punjab National Bank, Sector 15, Rohini Branch in favour of Respondent No.2, which is accepted by its AR, Mr. Shiv Kirti The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In view of respective Settlement Agreements dated 11.09.2025 and 27.10.2025, present Writ Petition have been filed. 8.

The parties have endorsed the amicable Settlements and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Settlement.

The parties have submitted that all the disputes have been amicably settled vide Settlement Agreements dated 11.09.2025 and 27.10.2025 and thus, no fruitful purpose will be served in continuing with the FIR. 10.

The present Writ Petitions have been signed by the Petitioners and are supported by their Affidavits. The parties have reaffirmed the terms of Settlement Agreements dated 11.09.2025 and 27.10.2025 and they submit that the said Settlements have been arrived at between the parties, without any pressure and coercion.

Respondent No.2 states that it has received all amounts due to it and has no objection if the FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served in continuing with the proceedings. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the aforesaid FIR in question.

Consequently, FIR No.0169/2025 under Sections 316(4)/318(4) BNS, registered at PS: Crime Branch, Delhi and all consequential proceedings emanating therefrom are quashed.

Both Writ Petitions along with pending Applications are disposed of. 16.

Accused Gaurav Singhal (Petitioner in W.P.(CRL) 3734/2025), who is stated to be in judicial custody, be released forthwith, if not wanted in any other offence.
