Present public interest petition has been filed seeking issuance of directions to respondents to remove illegal encroachment on public property bearing House no. 18A, Gali No. 1, East Laxmi Market, Patparganj Road, Laxmi Nagar, Delhi-110091 ("subject property"). 2.
Learned counsel for the petitioner states that the subject property on which illegal construction has been undertaken is public land. construction on the subject property and the same was demolished as recorded in order dated 18th December, 2013 passed in W.P.(C) 7843/2013. 3.
He states that thereafter, illegal construction has been again undertaken at the subject property without obtaining any sanction plan from respondent no. 2/Municipal Corporation of Delhi. 4.
He states that the petitioner made a representation dated 1st August, 2024 to MCD, SHO (P.S. Preet Vihar) and Chief Secretary, Govt. of NCT of Delhi, however, no response has been received. 5.
Keeping in view the aforesaid, this Court directs the present writ petition to be treated as a representation to the STF, who is directed to decide the same in accordance with law, as expeditiously as possible. 6.
Learned counsel for MCD shall forward a copy of this order along with the writ petition to the STF forthwith. The rights and contentions of all the parties are left open.
