The parties in this suit for declaration that the agreement between the parties stands frustrated were referred to the Mediation Cell of this Court. 2.

Mediation has been successful with the efforts of Mr. Mayank Goel, Advocate/Mediator and a Settlement Report and Memorandum of Understanding both dated 17th May, 2016 signed by the plaintiff and both the defendants and their respective advocates and the Mediator has been received from the Mediation Cell of this Court. 3.

The counsel for the plaintiff supports the settlement. 4.

None appears for the defendants.

The counsel for the plaintiff states that in view of the settlement, the plaintiff is to withdraw the suit and withdraws the suit. 6.

The suit is dismissed as withdrawn leaving the parties to bear their own costs.
