This writ petition has been preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking promotion to the post of Senior Manager (Personnel), as also for quashing the office order dated 20.08.2024 passed by the Respondent/Delhi Transport Corporation ('DTC'). 2.
Since the reliefs claimed are in the nature of 'service matters' under Section 3(q) of the Administrative Tribunals Act, 1985 and DTC is notified under Section 14 of the Act, the Central Administrative Tribunal will be the only Court of first instance to adjudicate the issues flagged by the Petitioner, in view of the judgment of the Constitution Bench of the Supreme Court in L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261. 3.
At this stage, learned counsel for the Petitioner, on instructions, seeks to withdraw this writ petition with liberty to approach the Tribunal.
