The petitioner assailed closure of defendant's evidence in commercial suit when despite four opportunities, no evidence was led by petitioner and even cost was not paid; the learned trial court before closing the defendant's evidence even passed over the matter granting opportunity to the petitioner to clear the previous costs, but the same was not done. 2.

After addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn.
