These petitions have been filed seeking anticipatory bail in FIR No. 338/2024 PS Lajpat Nagar under Sections 318(4)/336(2)/338/340/3(5)/61(2) of the Bharatiya Nyaya Sanhita, 2023. Counsel for petitioner points out that the ASJ (FTC)-03, South East District, Saket Courts had not entertained the anticipatory bail application on 03rd October, 2024 on the basis that the quashing petition was pending before this Court. 2.
This Court on 27th September, 2024 in W.P.(CRL) 3027/2024 titled Ashwani Bahuguna and Ors. v. State Govt of NCT of Delhi and Anr. had issued notice and gave directions for filing of Status Report as also clarified that pendency of the said writ petition will not impede any investigation or further proceedings in this matter. The matter is listed on 30th January, 2025.

In these circumstances, there is no impediment for the ASJ to decide the anticipatory bail application of the petitioner on its own merits, uninfluenced by the pendency of the quashing petition before this Court. 4.
Accordingly, the matters are remanded back to the ASJ, South-East District, Saket Courts.
