By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 0259/2019, dated 22.06.2019, lodged at Police Station Mohan Garden, under Section 302 of the Indian Penal Code, 1860 ["IPC"]. A charge-sheet has been subsequently filed on 04.09.2019, whereupon charges under Section 201, 394 and 411 IPC have been added.

After some arguments, Mr. Sarthak Maggon, learned counsel for the applicant, seeks permission to withdraw the present bail application, without prejudice to the rights and remedies available to the applicant before the learned Sessions Court, at the appropriate stage, in accordance with law.

It is Mr. Maggon's contention that the proceedings before the learned Sessions Court have not progressed on account of the nonappearance of certain prosecution witnesses. the testimony of four persons, who have been cited as prosecution witnesses, namely, Dr. Rajeev Ranjan Sharma, Dr. B.M. Prathua, Dr. B.M. Mishra, and Dr. Dheeraj Bhardwaj, Senior Scientific Assistant (Biology), FSL, be recorded first, after which the applicant would approach the learned Sessions Court afresh. In this regard, he has handed over an order dated 20.03.2026 passed by the learned Sessions Court, which is taken on record.

Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor for the State, has no objection to the aforesaid course of action and submits that the prosecution shall cooperate in ensuring the expeditious progress of the proceedings.

In view of the above, the parties are at liberty to request the learned Sessions Court to summon the aforesaid witnesses and record their evidence as expeditiously as possible.

It is made clear that the applicant shall be at liberty to approach the learned Sessions Court afresh at the appropriate stage. It is further clarified that, in the event of any inordinate delay in the recording of the evidence of the prosecution witnesses, the rights and remedies of the applicant shall remain reserved.

This Court has not expressed any opinion on the merits of any future application that may be filed by the applicant. 8.

The bail application, alongwith the pending applications, is accordingly dismissed as withdrawn, with the aforesaid observations.
