O R D E R
% 15.01.2026 By way of the present petition filed under section 483 read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks interim bail for a period of 08 weeks to avail treatment for his multiple ailments from a private hospital. 2.
Pursuant to order dated 05.01.2026, updated Nominal Roll dated 14.01.2026 has been received from jail.

Updated medical status report dated 31.12.2025 is also on record. 4.
Mr. Gaurav Sharma, learned counsel for the petitioner submits, that as would be seen from a perusal of the medical status report, the petitioner is a diagnosed patient of HIV and HCV; and is also under treatment for various other ailments, including bleeding per rectum. 5.

had to be sent on multiple occasions to G.B. Pant Hospital and Lok Nayak Hospital for various procedures in relation to his rectal bleeding, where it was found that he suffers from haemorrhoids. 6.
Counsel submits, that though, based on the examination at the Lok Nayak Hospital, the jail doctors have recorded that at present the petitioner has been advised sitz bath, medications and that no surgical intervention has been advised, the recurrence of the problem shows that, at the very least, the petitioner needs a second opinion. Counsel submits that the petitioner would want to consult private doctors for that purpose.

Insofar the nominal roll of the petitioner is concerned, upon being queried, counsel submits that though the petitioner has two convictions to his name, he has already undergone sentence in both cases; and in the other cases that are pending against him, he is on bail.

On the other hand, Ms. Shubhi Gupta, learned APP submits, that apart from his previous criminal antecedents as evident from the nominal roll, it may also be noticed that the petitioner's overall jail conduct has been 'unsatisfactory'.

Upon considering the foregoing facts and circumstances, what prevails with this court at this stage, are the following aspects: 9.1.
The fact that the petitioner is suffering from HIV, HCV as well as haemorrhoids is borne-out from Medical Status Report dated 31.12.2015.

September 2025 and December 2025, the petitioner has had to be taken to two separate government hospitals on 05 occasions. 9.3.
Though there is no gainsaying the fact that the petitioner has two past convictions, it is also on record, that he has already undergone sentence in both those cases. It is also a matter of record, that the petitioner is on bail in all other pending cases against him.

Though the nominal roll also discloses that the petitioner's overall jail conduct has been 'unsatisfactory', however he has already been awarded prison punishments for such conduct. 9.5.
The nominal roll further shows that the petitioner has been in custody for about 02 years and 09 months.
10. On an overall conspectus of the foregoing circumstances, this court is inclined to grant to the petitioner - Mangal Ram @ Ravi s/o Suraj Bali - interim bail for a period of 04 weeks from the date of his release, subject to the following conditions:
10.1. The petitioner shall furnish a personal bond in the sum of Rs. 15,000/- (Rs. Fifteen Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;
10.2. The petitioner shall not leave the State of Delhi without permission of the learned trial court and shall ordinarily reside at the address as per prison records/as mentioned in the application;

am and 11:30 am to mark his presence. However, he will not be kept waiting for longer than an hour for this purpose; 10.4. The petitioner shall furnish to the Investigating Officer/S.H.O P.S.: Paharganj, Delhi a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times; 10.5. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent and shall not travel out of the country without prior permission of the learned trial court; 10.6. The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial; 10.7. Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.
11. As requested on behalf of the petitioner, the Jail Superintendent is directed to furnish to the petitioner a complete set of his medical records as available in jail, at the time of his release.
12. The petitioner is directed to furnish to the Jail Superintendent copies of the medical records evidencing the treatment that he undergoes while on interim bail, at the time of his surrender.
13. Nothing in this order shall be construed as an expression of opinion on the merits of the pending matter.

14. A copy of this order be sent to the concerned Jail Superintendent forthwith.
15. The petition stands disposed-of.
