The petitioners have assailed order dated 09.05.2025 passed by the learned trial court, whereby on the basis of mediation settlement, after recording statements of both sides, the suit was decreed as compromised and a consent decree was passed.

Learned counsel for petitioners contends that the petitioners wanted a withdrawal simplicitor of the suit and not a consent decree, because the respondent has to execute a sale deed of another property in favour of the petitioners. But admittedly, there is no such reference in the mediation settlement. Learned counsel for petitioners submits that clause 4 of the mediation settlement stipulates that present petitioners no. 2-4 and the respondent shall not claim any right, title or interest in property bearing no. 3A/23, Basement and Ground Floor, W.E.A Karol Bagh, Delhi and in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. another property bearing no.3A/22, Basement and Ground Floor, W.E.A Karol Bagh, Delhi, therefore, execution of the sale deed by him is required. 3.

After addressing partly, learned counsel for petitioners seeks permission to withdraw this petition with liberty to institute appropriate proceedings in accordance with law.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
