Dr Smita Arora v. Dr Manu Bhai Gaur

CORAM:

% 17.09.2025 1.
The petitioner has filed this contempt petition alleging violation of the interim order dated 23.08.2018 passed in W.P.(C) 8817/2018. 2.
The captioned writ petition challenges the discontinuation of the petitioner's services as a Lecturer at Chaudhary Brahm Prakash Ayurved Charak Sansthan.
3.
By the interim order dated 23.08.2018, this Court noted that the letter dated 11.08.2018, by which the petitioner was informed that her services would be discontinued, did not disclose any valid grounds for such action and, accordingly, stayed the operation of the said letter. 4.
In the contempt petition, it is not alleged that the petitioner's services have been discontinued. Rather, the grievance pertains to her salary structure, benefits, and entitlements, including annual increments, CONT.CAS(C) 1409/2025 Page 1 of 2 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. vacation leave, and allowances.
5.
These aspects were not the subject of the interim order. The question of instituting a contempt proceeding arises only in the case of a wilful violation of a clear and unequivocal order of the Court. Even if the petitioner has a right to the relief sought in the application, such a right does not, by itself, constitute a cause of action for contempt proceedings, in the absence of a definite and unambiguous order that has been violated. 6.
I do not find any direction in the order dated 23.08.2018 concerning the emoluments or other benefits claimed by the petitioner in the contempt petition.
7.
In view of the above, the present matter does not warrant the initiation of contempt proceedings. Accordingly, the contempt petition, along with the pending application, is dismissed, without prejudice to the rights and contentions of the petitioner to seek such orders in the captioned writ petition.
