Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of FIR No. 0439/2022 dated 25.06.2022 registered under Section 289 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') at P.S. Malviya Nagar and all other proceedings emanating therefrom, in terms of the Memorandum of Understanding ("MOU") dated 01.12.2024. 2.

Issue Notice.

Learned APP appearing on advance Notice, accepts the Notice on behalf of the State. Learned Counsel for the Respondent No. 2, accepts Notice.

It is stated that the dispute was arisen as the Dog of the Petitioner has bitten the Respondent No. 2.

The parties are present before this Court in-person today and have been identified by their learned Counsel and Investigating Officer. 6.

In terms of the MOU dated 01.12.2024, the Petitioner has paid Rs.55,000/- to the Respondent No. 2. The balance amount of Rs.30,000/- has been paid today through UPI in the account of Respondent No. 2, which is accepted by the Respondent No. 2.

The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily and thus, no fruitful purpose will be served in continuing with the FIR. It is, therefore, prayed that the present FIR No. 0439/2022 be quashed, in terms of the Settlement. 8.

The present Petition has been signed by the Petitioner and is supported by the Affidavit. The parties have reaffirmed the terms of the settlement arrived at vide MOU dated 01.12.2024 and they also submit that the said Settlement has been arrived at between the parties, without any pressure and coercion.

In view of the above fact that the parties have amicably resolved their differences out of their own free will and without any coercion and also the nature of the allegations, no useful purpose will be served in continuing with the proceedings. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. 10.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR No. 0439/2022 dated 25.06.2022 registered under Sections 289 IPC at P.S. Malviya Nagar and all other proceedings emanating therefrom are quashed.
