The present petition is filed challenging the order dated 11.09.2025 ('impugned order'), passed by learned Trial Court in SC No. 203/2023 arising out of FIR No. 992/2022, registered at Police Station Keshav Puram, whereby the petitioner's right to lead further defence evidence was closed on account of the absence of defence witness- Aastha Arora.

The learned counsel for the petitioner submits that the witness Aastha Arora is the wife of the petitioner and she was not present on 11.09.2025 due to some personal difficulty. He submits that the learned Trial Court closed the defence evidence without giving one more opportunity to the petitioner and listed the matter for final arguments.

The impugned order indicates that the learned Trial Court had permitted the petitioner to lead defence evidence. 11.09.2025, three defence witnesses were examined and were subsequently discharged. Only one defence witness-Aastha Arora remained unexamined.

It is pertinent to note that the petitioner has filed the present petition immediately without wasting any time. Thus, in the opinion of this Court, purely in the interest of justice and fairness of the trial and considering that not much time has elapsed, one last opportunity shall be granted to the petitioner to examine the defence witness Aastha Arora.

The learned Additional Public Prosecutor for the State states that he has no objection if the petitioner is permitted to examine the said witness, subject to the petitioner not taking any unwarranted adjournments.

In view of the above, the present petition is allowed and the impugned order is set aside to the extent that the petitioner's right to lead defence evidence was closed and the petitioner is permitted to examine the defence witness Aastha Arora on the date already fixed before the learned Trial Court, that is, 24.09.2025.

The petition stands disposed of with the aforesaid observations.
