This petition has been filed seeking quashing of FIR No.78/2021 U/S 323/354/354B/509/34 IPC P.S. Kapashera, basis settlement arrived at between the parties on 24th April 2024 with facilitation of Mediation Centre, Dwarka Courts, Delhi, which his on record of this Court. 2.

Petitioner nos.1 to 4 and respondent no.2, complainant are present in the Court and duly identified by the IO and their respective counsels. 3.

Respondent no.2 has no objection to quashing of the FIR subject to the petitioner ensuring quashing of FIR No.79/2021 at P.S. Kapashera lodged against her brother.

Complainant Smt. Sheela Devi, who is petitioner no.3 in these proceedings, is present before the Court and undertakes that they will take steps for quashing / compounding of offences in proceedings arising out FIR No.79/2021 at P.S. This undertaking is taken on record to which petitioner no.3 as also other petitioners shall be bound.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. 7.

Accordingly, the petitions are allowed and FIR No.78/2021 U/S 323/354/354B/509/34 IPC P.S. Kapashera and proceedings emanating therefrom are quashed.

Accordingly, the petition is disposed of. Pending applications are disposed of as infructuous.

Parties shall abide by the terms of settlement. 10.
