This is an application filed by the plaintiffs under Order XXIII Rule 1 of the Code of Civil Procedure, 1908, seeking to withdraw the suit with liberty to file a fresh suit.

Learned counsel for the plaintiffs' states that the plaintiffs seek leave to withdraw the present suit, as they are presently in the process of procuring the defendants' infringing goods, and the same are not yet available for being placed on record in the present proceedings. 3.

She also makes a request for the return of the Court Fees, as the plaintiffs intend to file a fresh suit against the defendants after they have purchased the said infringing goods, on the same cause of action. 4.

Considering the fact that no summons has been issued in the present suit as yet, the application is allowed without expressing any opinion on the merits of the case.

The suit is permitted to be withdrawn with liberty as prayed for. Refund of Court fees 6.

All future dates stand cancelled.
