By way of present petition, the petitioner seeks to assail the order dated 27.07.2024 passed by Family Court, South District, Saket Court, New Delhi vide which the present petitioner i.e. father of the minor child has been directed to pay interim maintenance @ Rs.15,000/- per month to the minor child.

Notably, the maintenance petition was preferred on behalf of the minor child through her mother thereby claiming that the minor child is a student of fourth standard and she has been incurring expenses towards maintenance, educational and extracurricular activities of the minor child. A breakup of the expenditure has also been given in the said petition. The Family Court has considered that both the parents are gainfully employed and bearing in mind the respective submissions, directed the present petitioner to pay a sum of Rs.15,000/- per month to the minor child. 3.

maintenance, this Court is of the opinion that no interference is required in the impugned order at this stage. However, it is clarified that in case at the time of disposal of the maintenance petition subject to evidence coming on record, the Family Court comes to the conclusion that the respondents are entitled for lesser or higher maintenance, the Family Court would be at liberty to grant adjustment of the arrears either way. 4.

Learned counsel for the petitioner prays for an extension in the time given by the Trial Court to the petitioner to clear arrears of maintenance, which is stated to expire on 27th October 2024. The same is hereby extended by a period of six weeks.

Needless to state that this Court has not gone into the contentions of either of the parties.
