O R D E R

The present suit has been filed seeking permanent injunction restraining the use of the mark by the defendant for selling counterfeit goods, i.e., PEGASUS device causing infringement of plaintiff's registered trademarks or logo MOBIL, MOBIL SUPER, MOBILUBE, MOBIL formative marks and in Class 04.

Learned counsel appearing for the defendant further submits that the defendant does not intend to use the mark of the plaintiff in any manner. The defendant has neither sold any counterfeit products, nor does he intend to do so.

Learned counsel appearing for the defendant further submits that the defendant has no objection if the suit is decreed in favour of the plaintiff and against the defendant, provided the plaintiff gives up its prayer for costs and damages.

Learned counsel appearing for the plaintiff upon instructions submits that the plaintiff is satisfied with the statement made on behalf of the defendant and accordingly gives up its prayer for costs and damages. 6.

Accordingly, with the consent of the parties, the suit is decreed in favour of the plaintiff and against the defendant in terms of para 50 (i), (ii) and (vii) of the plaint.

Let decree sheet be drawn up.

Accordingly, the present suit along with the pending application, stands disposed of.
