O R D E R

% 20.09.2016 Learned counsel for petitioner submits that matter has been settled with respondent no.2, inasmuch as, settled amount has already been paid. It is submitted that vide letter dated 29th December, 2011, respondent no.2 has informed the petitioner that loan account stands closed. Learned counsel for respondent no.2 admits that settlement has been arrived at and loan account has already been closed.

He submits that respondent no.2 has no objection if the matter is compounded in view of the settlement. In view of settlement arrived at between the parties and loan amount having been paid, offence under Section 138 of the Negotiable Instruments

Act is compounded and petitioner is acquitted. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
